If your Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) claim has been denied in Louisiana, you still have options. Many disability claims are initially denied, but the appeals process gives you a chance to provide additional evidence and fight for the benefits you deserve.

Find out if you qualify for SSDI benefits. Pre-qualify in 60 seconds for up to $4,018 per month and 12 months back pay.

Please answer a few questions to help us determine your eligibility.

Why Are Disability Claims Denied?

Your denial letter from the Social Security Administration (SSA) will state the reason for denial, which may include:

  • Lack of sufficient medical evidence
  • The SSA believes your condition is not severe enough
  • They determine you can perform your past work or adjust to other work

Understanding the specific reason for your denial is crucial to building a strong appeal.

When Should You Appeal?

You must file your appeal within 60 days of receiving your denial notice. Missing this deadline can require you to start a new application, delaying your benefits.

The Four Levels of Disability Appeals

1. Reconsideration

  • What it is: A different SSA examiner will review your entire application, including any new evidence you provide.
  • How to request: File your reconsideration request online at www.ssa.gov, by phone at 1-800-772-1213, or at your local Social Security office.
  • What to include: Updated medical records, recent test results, and detailed doctor statements explaining your limitations.

2. Hearing Before an Administrative Law Judge (ALJ)

  • What it is: If reconsideration is denied, you can request a hearing before an ALJ.
  • Why it matters: This stage allows you to present your case in person or via video and bring witnesses such as doctors or vocational experts.
  • Preparation: Be ready to explain how your disability affects your daily life and ability to work, and provide any new medical evidence supporting your claim.

3. Appeals Council Review

  • What it is: If the ALJ denies your claim, you can request the Appeals Council to review the decision.
  • Outcome options: The Appeals Council may uphold the decision, send it back for a new hearing, or reverse the decision.

4. Federal Court Review

  • What it is: If the Appeals Council denies your request or upholds the ALJ decision, your final option is to file a lawsuit in federal district court.
  • Note: This stage is complex and usually requires an experienced disability attorney to represent you.

How to Strengthen Your Appeal

To improve your chances of approval:

  • Continue medical treatment and obtain updated records
  • Request detailed statements from your treating physicians explaining why you cannot work
